1. Who we are and what these terms cover
MakeAGuest is operated by Spectrosin Technologies ("we", "us"). These Terms of Service govern your use of the MakeAGuest website and services: creating events and invitations, sending them to guests by email, text message and WhatsApp, and responding to invitations.
By creating an account, sending invitations, or responding to an invitation, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use MakeAGuest.
2. Eligibility and accounts
- You must be at least 13 years old to use MakeAGuest, and at least 18 to host events or buy credits.
- Hosts sign in with a one-time code or link sent to their email address, or with Google. You're responsible for activity under your account and for keeping your email account secure.
- Guests don't need an account: your personal invitation link, together with the email or phone number it was sent to, gives you access to your invitation. Don't share your link if you don't want others to see or change your reply.
3. Your responsibilities as a host
When you add guests and send invitations, you confirm that:
- you know the people you invite and have their permission to contact them by email and, where you choose SMS or WhatsApp, by text or WhatsApp message;
- the names, email addresses and phone numbers you provide are accurate and you're allowed to share them with us for this purpose;
- your event details, notes, uploaded designs and photos are lawful, and you have the rights to use them (including permission from people shown in photos);
- you won't use MakeAGuest for advertising, marketing, chain messages, fundraising solicitations, or any unsolicited bulk messaging.
You're responsible for your event and for any information you share with guests.
If you add co-hosts, they can see and manage the event and its guest list and send invitations and reminders, using your credits. You're responsible for what your co-hosts do on your event.
4. Guests and RSVPs
- Your RSVP (including replies to each function of a multi-day event), the number of additional guests, dietary notes, answers to the host's questions, and any message you write to the host are shared with the host and co-hosts of that event.
- If an event has a guest limit and is full, your "yes" may be placed on a waitlist. We'll email you if a spot opens up.
- You can change your reply using your invitation link until the event starts, or until the RSVP deadline if the host set one.
- After you reply, we email you a confirmation, if we have your email address. Hosts may turn on reminders, which we send on their behalf.
- Where the host offers it, you can also RSVP by replying YES, NO or MAYBE to an invitation text.
- The host and co-hosts can see whether and when you opened your invitation.
- If the host uses a potluck list, the host and co-hosts see what you've signed up to bring. Other guests only see which items are still needed.
- If the host uses door check-in, you'll get an entry pass (a QR code) when you're attending. Keep it to yourself: whoever shows it at the door is checked in as you.
5. SMS, WhatsApp and text message terms
Program: MakeAGuest event invitations and reminders. When a host invites you by text or WhatsApp and confirms you've agreed to receive it, you may receive: one invitation per event, up to a few reminders if you haven't replied, an "event is tomorrow" reminder if you're attending, and a notice if the event changes or is cancelled. Hosts who add their own mobile number may also choose to receive a text when their guests reply. Message frequency varies by event. Update and cancellation notices are limited to 3 per event in any 24 hours, and reminders to at most 4 per guest. Where the host offers it, you can also RSVP by replying YES, NO or MAYBE to an invitation text.
- Opt out: reply STOP to any text to stop receiving texts from us. You'll get one confirmation and no further texts. On WhatsApp, reply STOP or block the sender.
- Help: reply HELP, or reach us through our Contact page.
- Cost: message and data rates may apply, depending on your mobile plan.
- Where: text messages are sent to US and Canadian mobile numbers only. Guests elsewhere can be invited by email or WhatsApp.
- Carriers are not liable for delayed or undelivered messages.
- We don't sell or share mobile numbers or text-messaging consent with third parties for their marketing. See our Privacy Policy.
6. Credits and payments
- Designing and saving events is free. Sending invitations uses credits: one credit covers one guest, by email, text, WhatsApp, or any combination. Resending to a guest you've already invited, reminders, and RSVP confirmations don't use credits. Premium designs use an extra 5 credits once per event, charged when its first invitations are sent (or when an event that already has invitations out switches to a premium design).
- Messages about event updates and cancellations are free and limited to 3 per event in any 24 hours. Correcting a guest's email or phone is free until the guest has opened the invitation or replied; after that, changing to a different email or phone counts as a new invitation and uses one credit. When co-hosts send invitations, they use the event owner's credits.
- Credits are sold in packages at the prices shown on our pricing page. Payments are processed by Stripe; we don't receive or store your full card details.
- Credits don't expire while your account is open. They have no cash value and can't be transferred or exchanged.
- If an invitation can't be delivered by any channel you chose, the credit is returned to your account automatically.
- Purchases are non-refundable except where required by law or where we decide otherwise. If you think you were charged in error, contact us.
7. Your content
You keep ownership of the content you add, such as event details, notes, uploaded invitation designs and photos. You give us a limited license to store, display and send that content as needed to run MakeAGuest for you and your guests.
Uploaded designs and photos are shown to anyone with the invitation link. Photos added to an event's shared album are visible to the host, co-hosts and the event's invited guests; the host can remove any of them, and you can remove your own. We may remove content that breaks these Terms or the law.
Video invitations are created on your own device and aren't uploaded to us. You're responsible for where you share them.
8. Acceptable use
You agree not to:
- send spam, harassment, threats, or content that is hateful, sexually explicit, or illegal;
- impersonate others or invite people who haven't agreed to hear from you;
- try to access other people's invitations or accounts, or interfere with the service's security or operation;
- scrape, copy, or resell the service, or use it to build a competing product.
To report abuse, use our Contact page.
9. Third-party services
MakeAGuest relies on third-party providers for sign-in, hosting, email, text messaging and payments. Their services are governed by their own terms, and we're not responsible for their availability or for third-party websites linked from MakeAGuest, such as calendar, map, video-call and gift registry links.
10. Suspension and termination
You can stop using MakeAGuest at any time and ask us to delete your account through our Contact page. We may suspend or close accounts that break these Terms, put guests at risk, or harm the service. Unused credits on accounts closed for breaking these Terms are forfeited.
11. Disclaimers and limitation of liability
MakeAGuest is provided "as is" and "as available". We work to deliver every invitation and reminder, but we can't guarantee that messages will be delivered, delivered on time, or that the service will be uninterrupted or error-free.
To the fullest extent permitted by law, Spectrosin Technologies won't be liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if greater.
12. Changes, governing law and contact
We may update these Terms. If changes are significant, we'll tell you through the app or by email before they take effect. Continuing to use MakeAGuest after that means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules.
